How this goes wrong in handyman services

The recurring pattern is small jobs on a handshake that go unpaid. It is rarely a genuine dispute about quality. Far more often the client already has the benefit of your work and has quietly decided that paying is optional, because chasing it looks like more effort than the money is worth.

A $640 day of small repairs agreed over text. The customer pays $200 and goes quiet. The text thread is both your contract and your proof of the price, and it is why your deadline is four years under Code Civ. Proc. § 337 rather than two under § 339. Filing fee on $440 is $30.

The evidence that decides it

For a handyman services claim, a judge wants the text thread agreeing the job and price, and photographs of the work. Bring those in that order, numbered, with three copies — one for the judge, one for the other side, one for you. Without them you are asking the court to take your word for the agreement, the delivery and the amount all at once, and where it is your word against theirs a judge has no basis to prefer either.

The contract change worth making today

Confirm the job and the price by text before you arrive, even for small work. A two-line text thread is a written contract and gives you four years to sue instead of two.

Check which entity is suing before you file

An unincorporated sole proprietor invoicing in their own name can claim under $12,500. A corporation, LLC or partnership is capped at under $6,250 — half. The cap depends on who is suing, not who is being sued, and you cannot pick the more convenient one: the plaintiff has to be whoever actually contracted with the client. Look at the contract and the invoice.

How long you have

A written contract gives you four years from the breach (Code Civ. Proc. § 337) — and "written" is broader than people assume, covering an accepted quote, a signed estimate or an emailed scope the client agreed to. A purely verbal arrangement gives you two (§ 339). Your invoice is not itself a contract, but it is strong evidence that one existed and on what terms. Check your date.
